EPR Packaging Works

California SB 54: Packaging EPR

A practical starting point for businesses supplying packaging and single-use plastic food service ware into California: establish responsibility, prepare the evidence and track the current implementation requirements.

What does California SB 54 cover?

California’s Plastic Pollution Prevention and Packaging Producer Responsibility Act establishes EPR for single-use packaging and single-use plastic food service ware. Coverage is not limited to plastic packaging. Check each component against the definitions, exclusions and current Covered Material Categories (CMC) list.

Who must act under SB 54?

Start with CalRecycle’s “Are You a Producer?” screening tool to determine the responsible legal entity. Brand, manufacturer and import relationships matter; a supplier agreement alone is not a substitute for the California test.

CalRecycle’s guidance directs producers to apply to participate in CAA’s PRO plan, submit an independent producer application, or obtain a small producer exemption. Independent compliance requires an approved plan. Check the exemption and exclusion route and evidence rather than assuming a small business is automatically exempt.

Keep reporting, fees and packaging design separate

Create four workstreams: producer status and participation; component data and CMC reporting; fee forecasting; and source reduction, recyclability and compostability requirements. Progress in one does not establish compliance in the others.

CalRecycle’s PEPRS portal supports registration, data submissions and compliance documentation. Depending on the route and choice available, reporting may be managed through the PRO or self-reported. Follow current instructions for your entity.

What packaging information should you collect?

  • Legal entity, brands, SKUs and California supply volumes by period.
  • Each component’s format, material composition and measured weight.
  • A documented mapping to the current CMC list.
  • Supplier evidence and support for exemptions or exclusions.
  • Baseline and change records needed for source-reduction reporting.

This is a preparation checklist. Use the official reporting guidance for mandatory fields, units and calculation methods.

Check EPS food service ware immediately

CalRecycle states that the required 25% recycling rate for expanded polystyrene (EPS) food service ware has not been met. Producers are therefore prohibited from selling, offering for sale, distributing or importing EPS food service ware in or into California. Do not wait for the wider PRO plan to review affected products.

Questions businesses ask

Does lightweighting alone satisfy SB 54?

No. A lighter pack may be worth investigating, but source-reduction calculations, recyclability, reporting and other duties require separate checks. Validate changes against current guidance and product performance needs.

Does recycled content automatically reduce my fee?

Do not assume a discount. Use the applicable state, year, material category and published fee rules, and keep evidence of the packaging attributes used.

Is the CAA plan approved?

As checked on October 21, 2026, CalRecycle’s program page reports receipt on October 13 and an open comment period. This draft does not treat receipt as approval.
